These terms and conditions relate to the website of ORiGiN™ Theatrical Pty Ltd ABN 46 111 477 895 (ORiGiN™ Theatrical, we, us).

You are only authorised to access or use the website if you accept and agree to these terms and to our Disclaimer at http://origintheatrical.com.au/disclaimer.html which is incorporated into and forms part of these terms. 

Your continued use of the website is acceptance of, and agreement to be bound by, these terms. We have the right to exclude any users from accessing the website if they are found to be in breach of these terms. We may amend these terms from time to time and such amendment takes effect on posting on our website.

Musicals and plays represented by ORiGiN™ Theatrical

The amateur and professional acting rights to the works contained on this website are owned and/or controlled in Australia and New Zealand exclusively by ORiGiN™ Theatrical (the publisher). 

Every musical and play represented by ORiGiN™ Theatrical is a copyright work and you must apply for an enter into a performance licence agreement covering each and every performance beforehand. This is the case whether the work is being performed in full or part, if an admission fee is being charged or not, if the actors and production staff are being paid or not, if the profits are being kept, distributed amongst the cast and crew or given to charity.

A signed licence agreement must be received by ORiGiN™ Theatrical, and accepted and signed by us, and you must have paid all fees that are payable in advance, before any performances can take place.

A performance is given any time a work is acted before an audience. A royalty fee and/or other fees specified by us is payable before each and every performance regardless of whether it is for a non-profit organisation or if an admission is charged.  

The publication of this website does not mean that the amateur and professional performance rights are available for all works listed within. It is highly recommended that you apply for performance rights before starting rehearsals and/or booking rehearsal or performance spaces.

The works on this website are fully protected by copyright.  No alterations, substitutions or deletions can be made to these works without the prior consent of the publisher.  It is expressly prohibited to broadcast, communicate to the public, televise, film, videotape, record, translate or transmit to subscribers through a diffusion or other service that currently exists or is yet to be invented, these works or any portion thereof whatsoever without permission in writing from the publisher.

Copyright provides the creators with an incentive to invest their time, talent and other resources to create new works. Authors earn their living from the royalties they receive from book sales and from the performance of the work. Copyright law provides a legal framework for control of their creations.
    
Whenever any of the works are produced, the billing and credit requirements in the licence agreement must appear on all programs distributed in connection with the performance and in all instances in which the title of the work appears for the purposes of advertising, seeking publicity for the work or otherwise exploiting the work and/or a performance(s). 

While these works may contain references to brand names or trademarks owned by third parties, or make reference to public figures, ORiGiN™ Theatrical should not be considered to be endorsing or otherwise attempting to promote an affiliation with any of the owners of the brand names or trademarks of public figures. Such references are solely for use in a dramatic context.


Use of our website

We are not obliged to fulfil any order you place through our website unless the order is accepted by us.

You must not copy, modify, translate, publish, broadcast, transmit, distribute, perform, display, sell or reproduce the material contained on the website in whole or part, or use trade marks displayed on the website, without the express written approval of ORiGiN™ Theatrical.

This website uses “cookie” technology to assist in identifying registered users. If you do not wish information to be gathered on a cookie you should disable the acceptance of cookies by your web browser.

You must not, in connection with the website, provide any contaminated file, virus, worm, trojan horse or other harmful code or program, or interfere with the security of the website. 

You indemnify ORiGiN™ Theatrical against all liabilities, losses, damages, costs and expenses (including all legal costs, whether incurred or awarded) suffered or incurred by ORiGiN™ Theatrical in relation to any breach of these terms and conditions by you.

These terms of use are governed by and must be construed in accordance with the laws of New South Wales. Each party irrevocably and unconditionally submits to the non-exclusive jurisdiction of the courts of New South Wales and all courts that have jurisdiction to hear appeals from those courts and waives any right to object to proceedings being brought in those courts for any reason.
